These Terms govern your use of the Nivel 100 app, its websites and services (the “Service”). By creating an account, signing in with Google, Facebook or Microsoft, or exploring without an account, you accept these Terms and the Privacy Policy. If you do not agree, do not use the Service.
1. Who we are
The Service is provided by Nivel Cien Group (“Nivel 100”, “we”), based in Chile. Contact: soporte@nivelcien.lat.
2. Minimum age
You must be at least 14 years old to use the Service; if you are under 18, use it with the knowledge of your parent or guardian. In the European Union, if you are under the age set by your country (between 13 and 16), logging health data requires your parent’s or guardian’s permission. Damage Control, social features that put people in contact (such as GymBro) and other modules indicated in the app require you to be 18 and stay locked until you confirm you are an adult. If we learn that an account belongs to someone under 14, we will delete it.
3. Your account
- The information you provide must be true. You are responsible for your credentials and for what happens in your account; if you suspect unauthorized access, use “Sign out of other devices” and write to us.
- An account is personal: it cannot be sold, lent or transferred.
- Guest mode: you can explore without an account. An anonymous account linked to your device is created; if you do not use it for 90 days, it is deleted. If you later create an account, what you did as a guest moves to it.
- You can delete your account at any time from Profile → Legal and privacy. Deletion is permanent.
4. Health: please read
- Nivel 100 is not a medical service. Workouts, plans, macros, fasting, supplements, automatic suggestions, the Shadow, the Sensei and AI features are general wellness information. They do not replace a doctor, dietitian or other health professional.
- Consult a professional before starting an exercise program, a fast or a change in diet, especially if you have a health condition, are pregnant or take medication. Stop the activity if you feel pain, dizziness or shortness of breath.
- Damage Control is harm reduction for adults who have already made their own decisions. Nivel 100 never recommends starting to use substances, does not sell them and does not endorse their use.
- Calories, times and other figures are estimates.
5. Artificial intelligence features
Some features use third-party AI models (food photo analysis, routine generation, translation). Their results may contain errors: review them before relying on them. Do not send these features information you do not want processed.
6. Paid plans and purchases
- Paid plans (for example Nivel 101, Sensei or No Ads) and in-app purchases are billed through Google Play. Nivel 100 never sees your card details.
- Subscriptions renew automatically at the end of each period, at the current price, until you cancel them in Google Play. Cancelling stops the next renewal; you keep the plan until the end of the paid period.
- If a price changes, we will notify you before it applies to your subscription, under Google Play’s rules.
- Refunds: every purchase is voluntary and informed; before paying you see the price and what it includes. We only refund errors (a duplicate charge or a purchase that did not reach your account) reported through a ticket in Support. Google Play may offer its own refunds under its policy.
- Right of withdrawal: because digital content is delivered instantly, when you buy you agree that delivery starts immediately and you waive the right of withdrawal, to the extent the law of your country allows.
- A plan obtained as a reward, through a code or through your gym lasts for the period stated when you got it and has no cash value.
7. Coins, virtual items and Battle Pass
- Coins, cosmetics, consumables, Shadow items, and Battle Pass and Gacha rewards are a license to use within the Service: they are not your property, have no cash value, are not refundable, cannot be exchanged for money and cannot be transferred outside the app.
- Gacha spins are not bought with money: they are earned by leveling up.
- We may adjust prices, rewards or game balance to keep it fair. If we shut down the Service, we will give you reasonable notice.
- Cheating (tampering with records, automating actions, exploiting bugs) may lead to removing what was obtained or suspending the account.
8. Social features and conduct
Clans, Raids, challenges, rankings, the social profile, GymBro and the Feed are shared spaces. You may not:
- Use offensive, discriminatory or sexual names, images or text, or impersonate another person.
- Harass, threaten or expose other people’s data.
- Use GymBro or any feature to meet someone for purposes other than training.
- Use the Service for illegal or unauthorized commercial purposes.
The Feed only shows automatic milestones. We may remove content or limit features of an account that breaks these rules.
9. Sensei
A Sensei is a person independent from Nivel 100. Nivel 100 only provides the tool: it is not a party to what you agree with your Sensei and is not responsible for their work. A Sensei never sees your progress photos.
10. Gyms, brands and advertising
- Free plans show ads (Google AdMob) and placements from brands and gyms, always labeled “Ad” or “Sponsored”.
- Coupons, sponsored challenge prizes and offers are provided by each advertiser, under their own terms. Nivel 100 is not responsible for their products or services.
- If you submit an ad’s contact form, the details you confirm go to that advertiser, who handles them under its own privacy policy.
- If your gym uses Nivel 100, it sees counts and aggregate statistics, never your personal activity.
11. Intellectual property
The app, its brands, its art (including the Shadow), and the catalog’s texts, exercises, recipes and plans belong to Nivel 100 or its licensors. We grant you a personal, non-exclusive, revocable license to use them within the Service. What you log remains yours; you allow us to use it only to provide the Service to you.
12. Suspension and termination
We may suspend or close an account that breaches these Terms, puts other users or the Service at risk, or when the law requires it. If it is not urgent, we will notify you first and you will be able to respond. If we close an account with a paid plan without you having breached these Terms, we will refund the unused part.
13. Availability and liability
- The Service is provided “as is”. We do our best to keep it running at all times, but it may have outages, errors or changes.
- To the extent permitted by law, Nivel 100 is not liable for injuries or damages resulting from following workouts, plans, suggestions or content of the Service, nor for indirect losses. Nothing here limits the rights that consumer protection law in your country gives you.
14. Changes to these Terms
If we change these Terms, we will publish the new version with its date. If the change is significant, we will ask you to accept it in the app before continuing. Continuing to use the Service after a minor change means you accept it.
15. Governing law
These Terms are governed by the laws of Chile, and any dispute will be resolved before the courts of Santiago, without prejudice to the rights that the law of your country of residence gives you as a consumer.
